Al reservar un pasadía, estadía o evento en Blue Apple Beach House se acepta estos términos y condiciones. Todas las reservas deben ser realizadas por un adulto mayor de 18 años.\n​\n\nRESPONSABILIDAD PERSONAL​\n Al reservar, usted reconoce lo siguiente:\n\n \n\n​Blue Apple Beach House está remotamente ubicado en una isla, fuera de cualquier conurbación y a 30 minutos de Cartagena. La llegada a Blue Apple Beach House es en lancha, que requiere la capacidad física para abordar y desembarcar un barco sin asistencia. En caso de condiciones marinas y / o climáticas adversas, es posible que no se pueda acceder al muelle cercano al hotel, en cuyo caso el hotel organiza una transferencia de 5 minutos desde un muelle diferente en una motocicleta (en el asiento trasero). En el caso de condiciones marinas y / o climáticas extremas, el hotel puede volverse inaccesible y su reserva puede ser cancelada por su propia seguridad. Visitar una isla remota es una aventura por naturaleza y puede implicar una cantidad de riesgo personal. Blue Apple Beach House es inaccesible a los servicios de emergencia terrestres y solo se puede llegar por mar o aire.\n\n \n\nUsted es responsable de organizar un seguro adecuado para cubrir los costos incurridos por cualquier evacuación de emergencia médica como resultado de un accidente, lesión o mala salud.​ BPM se compromete a proporcionar el equipo de seguridad apropiado y legalmente requerido para todas las actividades y el transporte operado y cobrado por el hotel. Sin embargo, todos los viajes desde y hacia el hotel, y todas las actividades posteriores se realizan de forma voluntaria y con pleno conocimiento de los riesgos involucrados.\n\n \n\nBPM no acepta ninguna responsabilidad por ninguna consecuencia que resulte de su viaje aquí, su visita / estancia aquí o su participación en cualquier actividad. Usted es responsable de juzgar su propio nivel de condición física y capacidades. Los riesgos y peligros que pueden estar presentes durante cualquier visita incluyen, entre otros, la cancelación o el retraso de su visita, gastos adicionales incurridos, lesiones, deshidratación o incluso la muerte. Tales riesgos pueden ser el resultado de la participación en cualquier actividad deportiva o de aventura, como paseos en bote, paseos en moto, navegación, pesca, natación, buceo, senderismo, yoga, pilates, masajes, reflexología, paddle, tomar el sol, trotar, caminar en terreno salvaje y / o aldeas remotas, recorridos en vehículos, encuentros con animales e insectos locales, la falta de atención médica inmediata o medios de rápida evacuación en caso de emergencia, actos de fuerza mayor, huelgas o conflictos laborales, órdenes del gobierno, guerra, actos de terrorismo, fuerzas de la naturaleza, condiciones climáticas significativas, disturbios políticos o civiles, o cualquier otro evento de fuerza mayor.\n\n \n\nAparte de las actividades operadas por el hotel, existe la oportunidad de participar en actividades que no se ejecutan o controlan por BPM. El personal de BPM estará encantado de ayudar a organizar y reservar cualquier actividad, y puede ayudar con un método de pago si el proveedor no puede aceptar tarjetas de crédito y el cliente no tiene suficiente efectivo. Sin embargo, BPM niega toda responsabilidad y no hace representaciones legales o garantías legales con respecto a la seguridad o calidad de estas actividades, o los estándares del operador independiente o individuo que la maneja. Usted comprende que reconoce que cualquier asistencia brindada por el personal de BPM para ayudar a organizar actividades opcionales no constituye una renuncia a esta exención de responsabilidad ni crea representaciones y garantías por parte de BPM.\n\n \n\nPara garantizar la seguridad de todos, BPM recomienda que todos usen un chaleco salvavidas todo el tiempo mientras viajan en cualquier bote, jetski, kayak o paddleboard. Es su responsabilidad usar un chaleco salvavidas y asegurarse de que los niños bajo su cuidado usen los suyos. BPM no se hará responsable por artículos perdidos o robados.\n\n \n\nPor la presente usted acepta indemnizar y eximir de responsabilidad a BPM de todas las responsabilidades, reclamaciones, gastos, pérdidas y daños (incluidos los honorarios razonables de abogados y los costos que surjan o estén relacionados con la negligencia o actos dolosos de sus invitados, incluidos, entre otros, a la destrucción de propiedad o daños corporales causados por el consumo de productos alcohólicos).\n\n \n\nCuando viaje a Colombia, especialmente a una isla remota, es recomendable que su seguro de viaje cubra hasta $ 100,000 USD en lesiones personales / tratamiento médico y $ 200,000 USD en gastos de repatriación y evacuación, incluso servicios internacionales de rescate en helicóptero y ambulancia aérea. Su seguro de viaje también debe incluir cobertura para propiedad personal, retrasos y cancelación. BPM no acepta ninguna responsabilidad por el reembolso de los vuelos y otros gastos no reembolsables si cancela su visita por cualquier motivo, ya sea voluntariamente de su parte, como resultado de acuerdos de viaje fallidos, condiciones climáticas adversas o como resultado de sus acciones. Usted es responsable de comprender los detalles de su póliza de seguro de viaje, asegurando que su póliza cubra todas las actividades opcionales e incluidas, incluido el transporte en lancha hasta el hotel, y que no haya cláusulas de exclusión que limitarían la cobertura para cualquier tipo de actividad.\n\n​\n\nDROGAS​\nBPM prohíbe el uso de drogas ilegales de cualquier tipo y fomenta fuertemente el consumo responsable de alcohol.\n\n​\n\nDERECHO DE ADMISION \nBPM se reserva el derecho de rechazar la entrada con una causa justificable y de retirarlo de la propiedad si está creando un peligro para usted o para otros, afectando el disfrute de los demás o participando en cualquier actividad ilegal. Todo costo que resulte de haber sido retirado de una visita o de que se haya rechazado la participación en una visita correrá por su cuenta.\n\n \n\nLEY APLICABLE​\nLa legislación colombiana rige estos Términos y condiciones en la mayor medida permitida. Cualquier disputa relacionada con una visita a BPM o estos Términos y condiciones se iniciará en Colombia, donde residen jurisdicción exclusiva y sede. Si un tribunal u otra autoridad competente considera que alguna parte de este documento no es válida, el resto permanecerá en pleno vigor y efecto.\n\n \n\nCAMBIOS​\nDe vez en cuando, BPM puede necesitar cambiar sus Términos y condiciones debido a cambios en su negocio, o en sus intentos por atender mejor sus necesidades. BPM hará todos los esfuerzos razonables para publicar cualquier cambio en sus Términos y condiciones, incluida la publicación de los términos actuales en su sitio web. Por favor revise de vez en cuando para revisar cualquier cambio a su política.\n\n​\n\nRESERVAS ​& PAGOS​\nBPM acepta pagos con tarjeta de crédito y débito (Visa, Amex, MasterCard), y también transferencia bancaria o cheque (solo para residentes de Colombia). Las reservas para almuerzo y pasadía para grupos de más de ocho personas, o durante la temporada alta y días festivos, pueden requerir el pago de un depósito para ser confirmadas. Este depósito es reembolsable si la reserva se cancela por escrito antes de las 6 p.m. del día anterior a la reserva, o 24 horas antes de la reserva en temporada alta. Las reservas de alojamiento siempre requieren un depósito del valor total del alojamiento. Si el pago no se recibe dentro de las 48 horas posteriores a la reserva de la habitación, su reserva será cancelada. Las reservas de eventos requieren un depósito del 10% del valor total del evento. El 40% es pagadero 3 meses antes del evento y el restante con 2 semanas de anticipación.\n\n​\n\nDESCUENTOS & OFERTAS ​\nDe vez en cuando, BPM puede ofrecer precios reducidos en habitaciones o paquetes. El precio reducido se aplica estrictamente a las nuevas reservas solamente. Las reservas existentes están bloqueadas en su precio original y no tienen derecho a ningún precio reducido. Todos los descuentos y precios reducidos se aplican a discreción de BPM.\n\n​\n\nHOSPEDAJE EN EL HOTEL​\nLa ley colombiana requiere la presentación de un pasaporte válido o una identificación nacional colombiana al registrarse en un hotel. Si no puede mostrar dicha identificación, su reserva puede ser cancelada sin reembolso. BPM no permite que los menores de 18 años hagan el check-in con ninguna persona que no sea su padre o tutor nombrado y se reserva el derecho de rechazar el check-in (sin reembolsos) a cualquier persona que acompañe a un menor que no pueda demostrar el parentezco o legal estado guardián. Usted acepta que pagará a BPM la tarifa de la habitación por cada día de su estadía y cualquier cargo adicional hasta el momento en que salga de la propiedad del hotel. Usted es y seguirá siendo personalmente responsable de pagar el monto total adeudado a la salida a menos que se hayan acordado acuerdos de liquidación anteriores. Debe avisar a BPM de cualquier cambio en el número de personas reservadas y acordar pagar cualquier cargo adicional por personas adicionales no incluidas en el número indicado en el momento de la inscripción. El horario estándar de check-in se indica en la confirmación de la reserva (normalmente a las 3 p.m.). Usted acepta que BPM puede aplicar un cargo adicional si su tiempo requerido de check-in requiere que BPM mantenga la sala vacía el día anterior. Para calificar para un reembolso, la cancelación debe ser recibida por escrito. Alojamiento: BPM reembolsará el 50% del valor de la reserva si cancela su estadía hasta 30 días antes del check-in. Dentro de los 30 días posteriores al check-in, el depósito no es reembolsable ni transferible. Para calificar para un reembolso, la cancelación debe ser recibida por escrito. Eventos y Privatizaciones: BPM reembolsará 10% del valor de la reserva si cancela su evento hasta 30 días antes del día de su evento, despues de cual momento no es reembolsable ni transferible. Para calificar para un reembolso, la cancelación debe ser recibida por escrito.\n\n \n\nSi BPM se encuentra obligado a alterar o cancelar su reserva (cuando no se deba a factores fuera de su control, incluidos, entre otros, actos de fuerza mayor, huelgas o conflictos laborales, órdenes del gobierno, pandemia, guerra, actos de terrorismo, fuerzas de la naturaleza, condiciones climáticas significativas, disturbios políticos o civiles, o cualquier otro evento de fuerza mayor), BPM le informará lo antes posible. En estas circunstancias, puede elegir una de las siguientes opciones: o aceptar su oferta de un alojamiento de reemplazo en un hotel isleño comparable de igual o mayor valor. o Recibir un reembolso de todo el dinero pagado.\n\n \n\nNo se emiten reembolsos por cancelaciones debido a circunstancias fuera del control razonable de BPM, incluidos, entre otros, actos de Dios, huelgas o disputas laborales, órdenes gubernamentales, pandemia, guerra, actos de terrorismo, fuerzas de la naturaleza, condiciones climáticas significativas, disturbios políticos o civiles, o cualquier otro evento de fuerza mayor.\n\n​\n\nSe aplica un honorario administrativo / bancario de 3% a todo reembolso. \n\n​\n\nQUEJAS & RECLAMOS​\nCualquier persona que desee realizar un reclamo, presentar una queja o solicitar una compensación por cualquier motivo debe hacerlo por escrito o por correo electrónico dentro de los 30 días posteriores a la cancelación o finalización de la visita a gerencia@blueapplebeach.com.\n\n \n\nCualquier y toda la documentación de respaldo al reclamo o queja debe acompañar a la carta o correo electrónico. Cualquier reclamo o queja recibido después de este plazo no será aceptado ni revisado.\n\n \n\nLos reembolsos no se emiten por ningún motivo debido a circunstancias ajenas al control razonable de BPM, incluidos, entre otros, actos de fuerza mayor, huelgas o conflictos laborales, órdenes del gobierno, guerra, actos de terrorismo, fuerzas de la naturaleza, condiciones climáticas significativas, conflictos políticos o civiles. disturbios o cualquier otro evento de fuerza mayor.\n\n \n\nBPM se reserva el derecho de honrar o resolver estos reclamos a su exclusivo criterio.\n\n​\n\nPOLITICA TRATAMIENTO DE DATOS PERSONALES\nSu privacidad es muy importante para nosotros. En consecuencia, BPM ha desarrollado una política para que comprenda cómo recopila, utiliza, comunica y divulga información personal, una copia de la cual se encuentra aqui en su forma completa. Antes o en el momento de recopilar información personal, BPM identificará los propósitos para los cuales se recopila la información. BPM recopilará y utilizará información personal únicamente con el objetivo de cumplir los propósitos especificados por BPM y para otros fines compatibles, a menos que BPM obtenga el consentimiento del individuo en cuestión o según lo exija la ley. BPM solo retendrá información personal el tiempo que sea necesario para el cumplimiento de dichos propósitos. BPM recopilará información personal por medios legales y justos y con el conocimiento o consentimiento de la persona en cuestión. Los datos personales deben ser relevantes para los fines para los que se utilizarán. BPM protegerá la información personal mediante protecciones de seguridad razonables contra pérdida o robo, así como el acceso no autorizado, divulgación, copia, uso o modificación. BPM pondrá a disposición de los clientes información sobre sus políticas y prácticas relacionadas con la gestión de información personal. BPM se compromete a realizar sus actividades de acuerdo con estos principios a fin de garantizar que se proteja y mantenga la confidencialidad de la información personal Descarga la politica completa AQUI.\n\n​\n\nSOSTENIBILIDAD & INTERESADOS​\nBPM aplicará en su cuenta una contribución obligatoria a su fondo de impactos. Este dinero no genera lucro para la empresa, sino que está destinado a proyectos sociales y medioambientales en la isla de Tierra Bomba y en comunidades vulnerables de Cartagena. En 2025, el monto estipulado es de 20.000 pesos por estadía en el hotel y 4.000 pesos por persona para pasadías.. \n\n \n\nBPM es una empresa que fundamenta el desarrollo de sus actividades basado en los principios de la sostenibilidad por medio de acciones de sensibilización con sus empleados, clientes y huéspedes, promoviendo así la conservación del patrimonio natural de la región, la renovación tecnológica y paulatina que a futuro genere reducción de sus índices de consumo energético, hídrico y la disminución gradual de los residuos generados dentro del establecimiento y en los sitios donde se realicen actividades vinculadas con la operación turística. Buscamos promover la cultura de la comunidad, respetando las costumbres de los pueblos indígenas y promocionando la oferta turística de manera responsable, sin afectar los planes de vida de los mismos y la protección de los recursos naturales con acciones encaminadas a la conservación y uso sostenible de la biodiversidad de la zona. BPM se compromete a brindar capacitación al personal, buscando mecanismos para sensibilizar y concientizar a clientes, huéspedes y proveedores en prácticas sostenibles que contribuyan con el desarrollo y el fortalecimiento de las manifestaciones culturales, la educación regional y todas aquellas actividades relacionadas con el turismo.\n\nVer nuestra politica de partes interesadas (\"stakeholders\") AQUI.\n\n​\n\nPOLITICA PREVENCIÓN EXPLOTACIÓN SEXUAL DE MENORES​\nLa Política Prevención Explotación Sexual de Menores tiene como objetivo establecer las conductas que la Organización, esto es BPM Bolivar SAS. y sus compañías subsidiarias y todos sus Colaboradores, deben adoptar en el desempeño de sus actividades comerciales, para garantizar la protección de los derechos de los niños, niñas y adolescentes, a fin de evitar cualquier forma de explotación sexual, incluida la pornografía y el turismo sexual. Como documentos referentes se incorporan a esta Política los principios consagrados en la Convención sobre los Derechos del Niño y el Protocolo facultativo sobre la venta de niños, la prostitución infantil y la utilización de los niños en la pornografía, las leyes, normas y regulaciones emitidas por las autoridades locales en los distintos territories donde operan las compañías subsidiarias y en especial las regulaciones exigibles a las compañías subsidiarias que prestan servicios como transportadores aéreos. Sin perjuicio de la adopción de la Política por parte de los órganos societarios de cadauna de las compañías, el cumplimiento de la Política es exigible a todos los Colaboradores de las compañías integradas en BPM Bolivar SAS., bien sea que actúen como Directivos, Empleados o Terceros Vinculados, en los territorios donde éstas operan. Será responsabilidad de la Gerencia adelantar la divulgaciónde la Política para garantizar su implementación efectiva, lo que incluye la coordinación con el responsable de Recursos Humanos y Administracion, de las acciones legales que procedan para dicha implementación, incluyendo la presentación de denuncias y aplicación de sanciones administrativas, disciplinarias, contractuales o judiciales de ser el caso y las tareas de divulgación del marco normativo referente, en los distintos canales corporativos de comunicación incluidos la página web de Blue Apple Beach House y de las distintas unidades de negocio y el control de la actualización de la Política si es requerido, por efectos de cambios en el marco normativo referente. Para efectos de esta Política se adopta la definición prevista en la Convención sobre los Derechos del Niño que lo define como todo ser humano menor de dieciocho años de edad, salvo que, en virtud de las leyes locales la mayoría de edad se alcance antes de los dieciocho años. Explotación Sexual Infantil. Es la utilización de un niño, niña o adolescente en actividades sexuales o en la pornografía o promoción del turismo sexual independientemente de que haya o no lucro económico. Es explotación sexual comercial cuando hay a cambio una remuneración o cualquier tipo de retribución para el niño, niña o adolescente o terceros. Explotación Sexual Infantil en el ámbito del turismo. Es la explotación sexual comercial de un niño, niña o adolescente por una persona o personas que viajan dentro de su propio país o al extranjero, y emprenden actividades sexuales con niños, niñas o adolescentes, con la complicidad por omisión o acción de los proveedores de servicios turísticos. Pornografía Infantil. Comprende toda representación de un niño, niña y/o adolescente realizando actividades sexuales o incitando a ellas, toda representación de un menor con fines predominantemente sexuales, toda organización de espectáculos en vivo de representaciones sexuales en las que participaren niños, niñas y adolescentes. La pornografía puede transmitirse por cualquier medio. UNICEF o Fondo de las Naciones Unidas para la Infancia. Es un programa de la Organización de las Naciones Unidas (ONU) que provee ayuda humanitaria y de desarrollo a niños y madres en países en desarrollo. Convención de los Derechos de los Niños (CDN). Es un tratado internacional adoptada por la Asamblea General de las Naciones Unidas el 20 de noviembre de 1989 y al cual se han adherido más de 190 estados, que se comprometen a respetar los derechos de los niños. La CDN reconoce a los niños como sujetos de derecho, pero convierte a los adultos en sujetos de responsabilidades. Protocolo Facultativo. Es el Protocolo que complementa la Convención sobre los Derechos del Niño relativa a la venta de niños, la prostitución infantil y la utilización de niños en la pornografía. Resolución A/RES/54/263 de las Naciones Unidas emitido el 25 de mayo de 2000, entro en vigor el 18 de enero de 2002. En cumplimiento de la Política en materia de protección de los derechos de los niños, niñas y adolescentes sobre cualquier forma de explotación sexual, la Organización y sus Colaboradores se obligan a: 1. Cuando efectúen la programación, promoción, venta o prestación de los servicios hoteleros y restauracion y servicios conexos con los mismos, abstenerse de toda práctica, información u orientación turística, que de alguna manera promueva, insinué o pueda dar lugar a cualquier forma de explotación sexual, pornografía o turismo sexual, con niños, niñas y adolescentes, incluyendo el uso de material fotográfico, grabación o video. 2. Poner en conocimiento de las autoridades competentes, incluyendo las autoridades de turismo y hoteleria y de policía, cualquier hecho o situación que conozcan que sea sospechoso, que haya dado o pueda dar lugar a la explotación sexual de niños, niñas y adolescentes, incluyendo la existencia de sitios relacionados con las explotaciones sexuales de niños, niñas y adolescentes. 3. Las áreas responsables de los canales de comunicación internos y externos incluidos entre otros, revistas, página web, redes sociales, entretenimiento abordo, y la publicidad promocional en distintos medios de comunicación, se abstendrán de incluir material pornográfico con menores de edad. 4. Promover que sus proveedores adopten una política de alcance similar a la internamente adoptada, e incorporar en los contratos que celebren cada una de las compañías, la obligación para dichos proveedores de adoptar tal política. 5. Abstenerse de facilitar sus instalaciones a terceros, cuando se determine que van a ser utilizadas con fines de explotación o de abuso sexual, con niños, niñas y adolescentes. Marco Normativo referente Convención sobre los Derechos del Niño. Firmada por 192 países y ratificada por 190 países, a excepción de Estados Unidos, Somalia y Sudan del Sur, convirtiéndose en el tratado más convocado a nivel mundial durante toda la historia. Colombia ratificó la Convención sobre los Derechos de los Niños el 28 de enero de 1991 Protocolo Facultativo del Niño. Firmado por 161 países y ratificado por 132 países, entre los cuales se encuentran los países en los que operan nuestras compañías. El Protocolo Facultativo sobre la venta de niños, la prostitución infantil y la utilización de los niños en la pornografía entró en vigor internacionalmente en el año de 2002, este instrumento internacional criminaliza las violaciones de los derechos de la infancia y hace énfasis en la importancia de fomentar una mayor concientización pública y cooperación internacional en las actividades para combatirlas. Constitución Política de la República de Colombia. En el Capítulo 2 de los Derechos sociales, económicos y culturales, Artículo 44, consagra los derechos fundamentales de los niños. Son derechos fundamentales el de la vida, la integridad física, la salud, la seguridad social, y la alimentación. Asimismo se indica que serán protegidos contra toda forma de abandono, violencia física o moral, secuestro, venta, abuso sexual, explotación laboral o económica y trabajos riesgosos. La Constitución Política reconoce adicionalmente los derechos de los niños consagrados en las leyes y tratados internacionales ratificados por Colombia. Ley 679 de 2001. Por medio de la cual se expide un estatuto para prevenir y contrarrestar la explotación, la pornografía y el turismo sexual con menores, en desarrollo del artículo 44 de la Constitución. Mediante la Ley 679 de 2001 se adoptaron en Colombia, medidas de protección contra la explotación, la pornografía, el turismo sexual y demás formas de abuso sexual con menores de edad. En esta Ley, el Estado Colombiano se compromete con los principios de protección de la niñez y establece tipos penales por la pornografía y turismo sexual con menores de edad. De igual forma, esta norma establece la obligación de los prestadores de servicios turísticos, que comprende entre otros las agencias de viajes, los hoteles y los transportadores aéreos de participar en prevención de este tipo de conductas. Ley 1336 de 2009. Por medio de la cual se adiciona y robustece la Ley 679 de 2001, de lucha contra la explotación, la pornografía y el turismo sexual con niños, niñas y adolescentes. En el año 2009 se expidió la Ley 1336, en la cual se establece que las empresas prestadoras de servicios turísticos deben desarrollar un modelo de código de conducta, que promueva políticas de prevención y que eviten la utilización y explotación sexual de niños, niñas y adolescentes en el desarrollo de su actividad. Resolución 4311 de Agosto 30 de 2010. Por medio de la cual establece el contenido básico que debe tener el código de conducta o protocolo o código de ética de las empresas de servicios aéreos comerciales de pasajeros. El cual debe ser acatado por los representantes legales, directores, administradores y empleados. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.\n\nIf you would like to: access, correct, amend or delete any personal information we have about you, you are invited to contact us at hola@blueapplebeach.com.\n\nPROTECTION OF MINORS AGAINST SEXUAL EXPLOITATION\n\nThe Policy for the Prevention of Sexual Exploitation of Minors aims to establish the behaviours that the Organization, that is, BPM Bolivar SAS and its subsidiary companies and all its Collaborators, must adopt in the performance of their commercial activities, to guarantee the protection of the rights of children and adolescents, in order to avoid any form of sexual exploitation, including pornography and sex tourism.\n\nAs reference documents, the principles enshrined in the Convention on the Rights of the Child and the Optional Protocol on the sale of children, child prostitution and the use of children in pornography, the laws, norms and regulations issued by the local authorities in the different territories where the subsidiary companies operate and especially the regulations applicable to the subsidiary companies that provide services as air carriers.\n\nNotwithstanding the adoption of the Policy by the corporate bodies of each of the companies, compliance with the Policy is required of all Collaborators of the companies integrated into BPM Bolivar SAS, whether they act as Directors, Employees or Linked Third Parties, in the territories where they operate.\n\nIt will be the responsibility of the Management to advance the disclosure of the Policy to guarantee its effective implementation, which includes the coordination with the person in charge of Human Resources and Administration, of the legal actions that proceed for said implementation, including the presentation of complaints and application of administrative sanctions, disciplinary, contractual or judicial, as the case may be, and the dissemination tasks of the relevant regulatory framework, in the different corporate communication channels, including the Blue Apple Beach House website and the different business units and the control of the updating of the Policy if required, due to changes in the relevant regulatory framework.\n\nFor the purposes of this Policy, the definition provided in the Convention on the Rights of the Child is adopted, which defines it as any human being under eighteen years of age, unless, by virtue of local laws, the age of majority is reached before the eighteen years.\n\nChild sexual exploitation is defined as the use of a child or adolescent in sexual activities or in pornography or promotion of sex tourism regardless of whether or not there is economic gain. It is commercial sexual exploitation when there is remuneration or any type of compensation for the child or adolescent or third parties in return.\n\nChild sexual exploitation in the field of tourism is the commercial sexual exploitation of a child or adolescent by a person or persons who travel within their own country or abroad, and undertake sexual activities with children or adolescents, with the complicity by omission or action of service providers.\n\nChild Pornography includes any representation of a boy, girl and/or adolescent performing sexual activities or inciting them, any representation of a minor for predominantly sexual purposes, any organisation of live shows of sexual representations in which children and adolescents participate. Pornography can be transmitted by any means.\n\nUNICEF or United Nations Children's Fund is a program of the United Nations (UN) that provides humanitarian and development aid to children and mothers in developing countries.\n\nConvention on the Rights of Children (CRC) is an international treaty adopted by the United Nations General Assembly on November 20, 1989 and to which more than 190 states have adhered, committing to respect the rights of children. The CRC recognises children as subjects of rights, but turns adults into subjects of responsibilities.\n\nOptional Protocol. It is the Protocol that complements the Convention on the Rights of the Child regarding the sale of children, child prostitution and the use of children in pornography. Resolution A/RES/54/263 of the United Nations issued on May 25, 2000, entered into force on January 18, 2002.\n\nIn compliance with the Policy on the protection of the rights of children and adolescents on any form of sexual exploitation, the Organization and its Collaborators undertake to:\n\n1. When programming, promoting, selling or providing hotel and restaurant services and related services, refrain from any practice, information or tourist orientation, that in any way promotes, insinuates or may give rise to any form of sexual exploitation, pornography or sexual tourism, with children and adolescents, including the use of photographic, recording or video material.\n\n2. Bring to the attention of the competent authorities, including the tourism and hotel authorities and the police, any fact or situation that they are aware of that is suspicious, that has given or may give rise to the sexual exploitation of children and adolescents, including the existence of sites related to the sexual exploitation of children and adolescents.\n\n3. The areas responsible for internal and external communication channels, including, among others, magazines, the website, social networks, onboard entertainment, and promotional advertising in different media, will refrain from including pornographic material with minors.\n\n4. Promote that its suppliers adopt a scope policy similar to the one adopted internally, and incorporate into the contracts entered into by each of the companies, the obligation for said suppliers to adopt such a policy.\n\n5. Refrain from providing its facilities to third parties, when it is determined that they are going to be used for the purpose of exploitation or sexual abuse, with children and adolescents.\n\nRegulatory Framework regarding the Convention on the Rights of the Child. Signed by 192 countries and ratified by 190 countries, with the exception of the United States, Somalia and South Sudan, becoming the most widely called treaty worldwide throughout history. Colombia ratified the Convention on the Rights of Children on January 28, 1991, the Optional Protocol for Children. Signed by 161 countries and ratified by 132 countries, including the countries in which our companies operate. The Optional Protocol on the sale of children, child prostitution and the use of children in pornography entered into force internationally in 2002. This international instrument criminalizes violations of children's rights and emphasizes the importance of promote greater public awareness and international cooperation in activities to combat them. Political Constitution of the Republic of Colombia. In Chapter 2 of Social, Economic and Cultural Rights, Article 44, enshrines the fundamental rights of children. Fundamental rights are those of life, physical integrity, health, social security, and food. It also indicates that they will be protected against all forms of abandonment, physical or moral violence, kidnapping, sale, sexual abuse, labor or economic exploitation, and risky work. The Political Constitution additionally recognizes the rights of children enshrined in the laws and international treaties ratified by Colombia. Law 679 of 2001. By means of which a statute is issued to prevent and counteract exploitation, pornography and sexual tourism with minors, in development of article 44 of the Constitution. Through Law 679 of 2001, protection measures against exploitation, pornography, sex tourism and other forms of sexual abuse of minors were adopted in Colombia. In this Law, the Colombian State is committed to the principles of child protection and establishes criminal offenses for pornography and sexual tourism with minors. Similarly, this rule establishes the obligation of tourism service providers, which includes, among others, travel agencies, hotels and air carriers to participate in the prevention of this type of conduct. Law 1336 of 2009. By means of which Law 679 of 2001 is added and strengthened, in the fight against exploitation, pornography and sexual tourism with children and adolescents. In 2009, Law 1336 was issued, which establishes that companies that provide tourist services must develop a model code of conduct that promotes prevention policies and avoids the use and sexual exploitation of children and adolescents in the development of its activity. Resolution 4311 of August 30, 2010. By means of which it establishes the basic content that the code of conduct or protocol or code of ethics of commercial air passenger service companies must have. Which must be complied with by legal representatives, directors, administrators and employees. Likewise, from the issuance of this resolution, the code of conduct or the policies or protocols or the code of ethics of each company must be observed by the contractors that provide services related
